Documents required for SBS, TSS-482, RSMS-187 and ENS-186 visa nomination applications.

1. Lawful Operation Required Documents (MINIMUM ONE)

For us to prepare submissions to meet lawful operations test, we require the following relevant documents. Gather the required documents that apply to your business before progressing with this application.

For us to prepare submissions to address genuine position tests, we require the following documents. Please gather the listed documents before progressing with this application.

3. Financial Capacity Required Documents

For us to prepare submissions addressing financial capacity to meet compliance requirements for nomination application, the following documents are required. Please gather these documents before progressing this application.
Letter or statement from accountant needs to attest to the turnover, staff numbers, payroll and statement on solvency and capacity to pay wages and salary of nominated employee/s.

4. No Less Favourable Test Required Documents

For us to prepare submissions addressing 'No Less Favourable' Test and to meet compliance requirements for nomination application, the following documents are required. Please gather these documents before progressing this application.
For this application, you must provide a copy of employment agreement with nominee that is signed by nominee and management. If an Australian employee is currently or previously in an identical role doing the same work, please provide copy of the Australian employee's agreement.

5. Labour Market Testing Required Documents

For us to prepare submissions addressing Labour Market Testing and to meet compliance requirements for nomination application, the following documents are required. Please note that assessment is extremely strict by Departmental case officers and mandatory requirements must be met. Please gather these documents before progressing this application.
Advertising must have run for a total of 4 weeks within the past 4 months utilising 2 sources of online, print or radio advertising. Copy of advertising must show position description, tasks, pay range and company or recruiter details. NOTE: APPLICATION CANNOT PROCEED UNTIL THESE EVIDENCE ARE GATHERED.

7. Standard Business Sponsorship Grant Document or Application Summary

If application for Standard Business Sponsorship has been made, but no decision, provide application summary (available for download from ImmiAccount in which application was lodged). Provide this if available and a grant notice has been issued. This will help us with application preparation.

NOTE: Follow these instructions when considering the required documents checklist

  • This is a generic list, NOT ALL documents on the list are be relevant to your situation, select/de-select documents according to your situation, for example, “ABN’ + “ACN’ if your business is a company with ACN AND has a separate ABN. Request assistance if you are not sure.
  • Gather all items you have before commencing the data collection / upload form that comes after this form. If you supply all documents at the same time, we can complete legal submissions and have application ready for submission faster.
  • Official documentation in foreign languages MUST be accompanied with a certified translation. If in Australia, this could be a NAATI certified translator. If abroad, translations must be notarised or certified by appropriate legal authorities.
  • Scans of documents must be in full colour. Scans must be clear and legible. Scans featuring facial pictures must be very clear with no coverings on face, hair or neck area.
  • Scans of documents must be clear and legible. Missing parts of the page or hazy, shady or dark areas where text cannot be read may be rejected. The entire page / document must be clearly visible on the scan.
  • Incomplete or non-compliant documents may not be acceptable to Immigration case officers. Ask us if you need clarification, or simply upload and we will inform you if any documents are incomplete.
  • .pdf documents are preferred.
  • File size should be less than 5MB, as the Department’s systems do not handle large files. If a document is to exceed this size, compress or break up into a series of smaller files.
  • Comprehensive documentation will assist us to prepare submissions in support of your application. The sooner we receive these documents from you, the faster we can complete your application.
